Neither Ryan Bremner or StoneHouse Graphics will be held responsible for trademark infringement or copyright violation of images or content provided by client.

To comply with copyright law all other images will be original art created by Stone House Graphics, or otherwise royalty-free stock images.

All photographs, graphics, and other content created remain the intellectual property of the creating party with client license for perpetual use unless otherwise noted.

StoneHouse Graphics retains the right to utilize created content and/or likenesses in our portfolio for advertising and promotional purposes.

E-commerce packages do not include fees associated with payment processor or e-commerce operation.

All reasonable attempts will be made to ensure that code will be W3C-standard (X)HTML, PHP, CSS and Javascript.

Every reasonable attempt will be made to ensure pages will display properly in the majority of desktop and mobile modern web browsers.

Out of date browsers may not be supported.

Maintenance service covers security patches, plug-in updates, repairs when necessary and minor content and design changes. The expected turn-around for most changes will be 48 hours. Additional design and content creation post go-live will be billed at the agreed hourly rate  unless included with a concierge package.

All reasonable safeguards will be put in place to ensure the security and stability of the site, however, StoneHouse Graphics will not be held liable for unforeseen technical issues which cause a loss in site uptime and potential loss of income. This includes but is not limited to hosting server downtime or failure, server or site malicious intrusion, changes in third-party product compatibility or damage to site operability from the client-side administration.

StoneHouse Graphics is not an attorney service, our legal liability language provides basic compliance, customized for your site and may provide some insurance against fines, lawsuits and intellectual property disputes. For comprehensive protection and indemnity, we recommend consulting with a third-party attorney. SHG will not be held responsible for any fees, claims or other liabilities as a result of legal action against the client or the client’s company.

SHG does not offer an uptime guarantee on websites. However, our hosting partner provides a SLA of 99.9%.

Upon acceptance of estimate, 50% of total contracted fee and taxes will be required as a non-refundable deposit before project work begins. 

Remainder of estimate plus any additional charges will be due upon final delivery of project to client’s satisfaction. 

SHG holds agency licenses with many third-party developers which are included in the Hosting and Maintenance package fees. Licensing for other specialized products necessary for website operation may be billed to the client as needed with client consent. 

Contract may be terminated by either party. Termination by client without just cause or failure to pay will result in forfeiture of all fees and removal of intellectual property owned by SHG. 

If StoneHouse Graphics terminates the contract or is unable to fulfill the contracted maintenance post-launch, the client will be refunded a pro-rated amount not to exceed 50% of the total contracted amount.

For Hosting and Maintenance plans, non-payment for 2 consecutive pay periods will result in the website being suspended and all maintenance and concierge services halted. 

For Hosting and Maintenance plans, non-payment for 6 consecutive pay periods will result in the website being deleted and unrecoverable. 

SHG will release applicable domain names to the client upon termination to a registrar of the clients choice.
